Burger King claims that it never listed the “Impossible Whoppers” to be vegan. The action was taken against them by a vegan customer over the plant-based burgers being cooked on a grill used for meat burgers.
On Thursday, Burger King claimed that Phillip Williams should have questioned how the Impossible Whoppers were cooked before ordering the burger he claimed was “coated in meat by-products”.
Reasonable customers do question cooking methods and Williams should have requested an alternative method.
Plaintiff Williams assumed that Impossible Whopper would satisfy his strict veganism especially since he requested to hold back the mayo. Burger King said that this claim has no basis.
In his November 18th lawsuit, Williams claimed that he was duped by Burger King to buy the Impossible Whopper at a premium cost and is seeking damages on the part of all U.S. consumers who purchased the burger.
Burger King advertises the Impossible Whopper on its website at $4, down from its original suggested price of $5.59, and in mid-January added it to its two-for-$6 menu. In a statement, a spokesman said the product “continues to exceed expectations.”
